Small Claimts Court Costs (if you loose?)
Meniro started this topic @ 13:08 on 05/05/2011
I've got a customer that I've been chasing for payment on about £2,000 for three months now.
They're ignoring my emails, letters, calls.
So I'm looking into small claims, I've read around online and also on this site:
http://www.startups.co.uk/small-claims-guide.html
There's plenty of mention of the costs to put a claim in, but...if by some way you "loose" the claim, how much does it cost you?
Do you just loose your small claims court fees (intitial fees when claiming).
Or do you have to pay the 'defendants' costs, or damages as well?
Interesting or important topic? Please click "vote topic higher" if you think so.

Just your own costs, usually, whether you win or lose.
But if the judge believes one side has acted unreasonably, then he may award costs to the other.
You can claim the direct costs of making the claim (the court fee and solicitior's fee for preparing the claim), but NOT solicitor's fees for attending court.

Well that last response was one hell of a spammy link-filled post.
Just as an update - it turns out that if you do 'loose' or your claim is rejected then you just loose your court fee's (which is dependant on the amount you're claiming - in my case about £95).
Submitted my claim two weeks ago, just got the confirmation from the courts.
By the way, for anyone looking into this - some literature states that you need to only send one copy of supplementary evidence with your initial claim form (yes, even on the Gov website!).
This is wrong, is most cases it is THREE COPIES OF EVERYTHING.
(1 for the court, 1 for defendant and 1 to be sent back to you by the court)
You'll need to call the county court you're submitting your claim to, just to check how many copies they want.
If you don't send the right number, they'll most probably send the docs back to you again.
Some also offer a 'copying' service - but this costs about 50p per sheet.
(So if you send in only 1 copy, and ask them to make another 2 copies....and you've got 30 pages, then thats going to cost you £30)

Moneyclaim online by the courts is an easy way to lodge your claims. Fill in the details, make sure you claim appropriate admin fees (as set) and your interest (currently base plus 8% per annum). Hopefully the defendant will see this, not be awkward and pay. If not you then have to pay another fee and ask for it to go to court. They are currently pushing telephone mediation which is likely to happen before going all the way.
