Hi all,
I have been asked to help out a non-profit, environmental organisation with an email campaign it wants to run.
They are an honest, long-standing organisation and the email is promoting a free-to-enter competition.
They have bought a list of 45,000 names of companies that may be interested in the competition. I don't know how the list was compiled, but it is from a reputable company. The email is un-solicited.
Before I got involved, they tried to use their standard email addresses which are supplied by BT. Needless to say, BT did something to their email accounts and stopped the email being sent. They are using some bulk email software, I think it's called Campaign 9.
Is there a way for them to send this email legally and effectively?
I thought that they may need to install their own, private email server using a static IP connection supplied by BT, but would BT still intervene in the email transmission? My thought is that BT would only see the traffic as data rather than seeing it as emails.
Also, do we need to get the server whitelisted?
And, where can I find a simple explanation of the law governing unsolicited emails to businesses?

- NO, UNLESS YOU USE THIRD PARTY OR OFFSHORE SERVER
I thought that they may need to install their own, private email server using a static IP connection supplied by BT, but would BT still intervene in the email transmission? My thought is that BT would only see the traffic as data rather than seeing it as emails.
- BT WOULD CERTAINLY NOTICE THAT VOLUME OF TRAFFIC

Unless you are sending the bulk emails from a country that is not compliant with the CAN-SPAM Act, sending all bulk email messages at once is very likely to cause you trouble, as your email provider will catch all emails and suspend your account. Even if these emails pass the filters of your own mail server provider, they will likely get your email address black-listed on anti-spam servers, due to the high frequency of outgoing bulk emails.

Hi Mr. Sussex,
Well, It's illegal to send SPAM emails and since the list isn't an Opt-In List, it would be illegal to send bulk emails there, but you can outsource it without outsourcing the whole job (and it's factually only spam if your recipients see and flag it as spam), all you need to do is to use an external outgoing SMTP server (http://www.mailgun.com , http://www.sendgrid.com .....etc) , there are a lot around and combine it with a bulk emaill sending application, I have had good experience with http://www.bulkmailapp.com + Sendgrid. If you use the pay as you go plan of Sendgrid, it costs 0,10/1000 emails sent, so for your campaign, this will cost you $4,50 USD . Well, you can't beat that price but of course, you have many other options from Sendgrid or Mailgun, but that's what I use and it works. However, here are a couple of things you should keep in mind, you might need a domain (you can use your organisation domain for this, or any other domain you wish) to register a sendgrid account.
The other great thing about the Bulkmailapp is, it allows you to personalized and merge your emails, so your readers won't see it as a mass email, but as an email tailored just for them, and you can set a Sender email of you choice to receive the answers.
The app cost $39 (1 time fee) + $ 4,5 USD for your 45,000 emails = $ 43,5 USD . That's hardly money your organisation doesn't have.
, so once you know how to do it, it's really very cheap and less risky and if you get banned, you will get banned by Sendgrid not your email provider.

Email marketing is one of the most utilized marketing strategy nowadays. There are quite a few misunderstandings about spam (and due to that misunderstanding, a lot of people falsely mark good emails as spam). If an email address is published online and you are invited to email them, then you have every right to do so providing it is compliant with what they are requesting.
If it does then you're ok. Take as an example business networking, lot's of people publish their details in view of networking.
The difficulty in emailing them is that unless they have subscribed to you prior to you emailing them, it is very likely to hit their spam folder which in my opinion is pretty worthless. Sites like elance or odesk have people on there who will bulk email for you, however be aware that most of your emails will not hit the inbox.

I think it wouldn't be marked as spam if the people on the list are kind of expectant to receive an e-mail about whatever it is you will be promoting from your company. You should then start off by introducing yourself through the SEVEN-DAY method which is a common method used by e-mail marketers. The first few days would be properly outlining who you are as an introductory e-mail so that your readers will not be receiving e-mails from anonymous persons or companies, but from a reputable and well-known person or company as per your introduction.

There are certain web services that may be able to accommodate your needs. Mailchimp and Toutapp both allow you to send mass emails while still adhering to the CAN-SPAM Act.

Just because it's not porn of viagra pills makes this no less spam. As pierrep recommends; MailChimp are awesome, but they wouldn't very much like a non-double opt-in list being added to their system.
Besides, the conversion rate I'd expect to be very low. Building a healthy double opt-in list will reap much better rewards in the long-run.

The UK law refers to individuals
"This legislation says that organisations must only send marketing emails to individuals if you have agreed to receive them, except where there is a clearly defined customer relationship."
SO you can't send me joe.blogs@example.com and e-mail without having a permission or a defined customer relationship
However, you can send e-mail to a generic business e-mail address, that is not attached to an individual, e.g. info@megacorp.com
The OP say "They have bought a list of 45,000 names of companies that may be interested in the competition." so it may be that they are not individual's e-mails.
As to technically, there are dozens of bulk email companies, and they also can advise on teh exact legalities of 'spamming' businesses, as opposed to teh illegal activity of 'spamming' individuals.
