i've been working on an idea since before Christmas and was planning to launch later this year
Have just found out that the trading name i was going to use has just been registered with Companies House on 21 April 04.
Am i right in thinking that i can still trade with the same name, but if i am to register i will need to use another (ie. Gines Ltd trading as ....)
The company with the same name is based in Scotland so will that affect anything.
Please help as this has driven me to a complete panic !!

Dan,
I believe u can do xco ltd trading as .......
Problem may still arise if u are trading as...and the company does the same or similar service or product...
They call it "Passing Off" I believe....
What do the other company do???...is it the same as u..or indeed similar?

Hi Dave,
There is no description of their business on companies house. They have no website and i cannot find any information whilst doing a search on their registered address.
worried...hopefully unduly !

i should add that i own the domain names (.co.uk and .com) for the business name...

Owning the domain names means not a lot to be honest.....
However....the fact that they havent built up a brand ....or publicised who they are etc....I would gues means u have a pretty strong case for going ahead. Possesion being nine tenths etc....u were there first with the marketing etc.
I had a similar problem with a domain name recently and the chap who thought he owned it didnt. We sorted it out amicably. No problems and no costs.
I realise my information in sort of Annecdotal and it wouyld be helpful if someone with a more indepth view of these matters could respond and maybe put your mind at risk.
If no a call thru to someone like the DTI???
