Hi,
I'm thinking of opening up my own website for trading purposes. The problem is that the name I was going to use is registered in companies house. Now, the question I need answered is, if a company is registered as say....XYZ Ltd, am I infringing on their name by opening up a website called www.xyd.co.uk?

I think domaine names have a separate register. Ask companies house the question, but anyway reg the domaine name, first in first get.

If this was still the wild-west Internet [B)] of pre year 2000 then Brian would be correct. But we now have "Sheriffs" in place so Brian is NOT correct!
If Nominet were to judge you not to be the legal owner of a domain then
"Nominet has the power to transfer, cancel or suspend the Domain Name registration"

Similar rules now apply to TLD (.com, .net ect.).
You are best selecting a name that is still available both at companies house, check here:
http://www.companieshouse.gov.uk/info/
and check the availability of domain names on the Internet here:
http://www.seiretto.com/whois/

I would agree with Dave, (brian has lots of odd opinions, things must be different in France), the existing company could make a claim on this domain.
However - do you know if this is actually a trading company?
Or are they dormant?
Are they in the same business as you if they are trading?
Well worth a look on the companies house site to see if accounts have been filed (you can dowload the actual accounts for a small fee), and prehaps getting in contact with the owner to ask if they have any objection to using the domain.
A fair chunk of registered companies are never actually used or are no longer in existance, and they may let you have it. Well worth a little dig around.

It would also depend on how big this trading company was, and how much they value their trading name and what line of business they are in, they would look at it, as though you were riding on their back to promote. If you used your example and put it as x-why-z, you most certainly would be infringing on their name.

Good to see you agree - I must say I also agree with your alternative approach to check the company name is actually being used.
Trouble is though - enquiries could spark a unrealistic values being asked for the name.
I have not been around for some time as I have been persuaded away by other better forums. Having been told we are a bunch of amateurs by admin, tired of the pop-up ads, and having every post LITTERED with adverts - I am slightly miffed.
