In a situation where a 6 month tenancy is to be renewed is it sensible to have a new agreement issued or would a memorandum to the original tenancy agreement suffice?
I have been offered the latter option by my letting agent but its the first time I have come across this situation and I don't know if its valid.

Are you referring to a domestic tenancy, an assured shorthold tenancy?

A few things can happen. The landlord can give you two months notice to leave, he or she can also offer a different type of tenancy, offer another assured shorthold tenancy agreement, for another period or just simply allow the tenancy to continue on the same terms after the 6 months.
I suggest that as there is no legal requirement to have another bit of paper you can chose what you feel would make you happier. Now the 6 months has passed you can be given under these sorts of tenancies 2 months notice to quit so that is why the landlord or their agent seems so laid back! If they do nothing at all the terms will just continue under the original agreeement.
Bear in mind that we have no way of checking the sort of tenancy so if you have any doubts get your local CAB to check it out for you as they can look over the documents. They do it for free we charge £20 plus VAT to look over the paperwork.

It's my friend's property Lee, he is the landlord. However, his letting agent has produced a memorandum document to continue the tenancy with the existing tenants. However, in the past he has received new tenancy agreements. He's a bit puzzled.

Hi Misstique,
Your friend should get in touch. Serial tenancy agreements can create over time a different structure of tenancy relationship. This may be a good thing for the tenant ( see my advice to you) from a landlord's perspective it carries risk.

Thank you, Landlord and Tenant law is a complex area as it has been reformed but it is still quite messy!
