Hello,
I am in the process of setting up my first company - Smartvibes Ltd - a website selling sex toys to women who find Ann Summers etc. a bit down-market.
Anyway, the website is being built at the moment and I have decided to go with Worldpay as a means of processing credit card orders. This seems to put me in a bit of a grey area with regards to Data Protection notification and the need for a Consumer Credit License. Thing is I will be holding data on people in order to fulfil orders and for my own records (in case someone returns a product). My impression thus far is that I may be exempt from notifying.
As for the CCL - am I right in thinking that by accepting credit card payments (albeit through Worldpay) that I am offering credit and thus need a CCL?
I really am at my wits end at the moment - I've sorted out my product range, suppliers, look and feel of the site etc. but I am getting seriously bogged down by all the legal implications.
I've read all the leaflets and checked out the Government websites but I really can't get a straight answer.
Any help would be gratefully recieved.

You wont need a CCL, you will only need one if you are offering your products on credit (ie to be paid in monthly instalments). So unless you have some fairly "hardcore" expensive products and are offering credit on those items you wont need a CCL.
My impression is that you will almost certainly have to notify for dpa. It will be dependent on how you will specifically use the information, from a business point of view would you not want to hold onto customer info for various future income stream purposes? Either way you will need to notify, you will need to look at the different strands, but go under the basic "processing". The web site for the dpa is actually very good and you can even fill it out online.
Sorry a little vague, cant remember specifics too late, too tired. Database Administrator by trade so work with the implications of it daily.

Thanks for the advice TT - much appreciated.
I thought that would be the case with the CCL - It was the guy at Business Link who told me I would need one. He didn't sound very convinced when he told me either!
All the Business Link guy kept banging on about was Cashflow Forecasts. As I am not seeking a bank loan to get my business up and running, that seemed slightly pointless at this stage. Surely it would be easier to predict cashflow in a few months, when I've actually had some!
