Hello people,
In Oct 2004 I paid for some items from a company in the states, the items never arrived, due to having taken out insurance the company said they would re-ship a replacement order. This second order has not arrived either so I have asked for a refund. The US company said no chance as they had already shipped the items, but beings as I never recieved the items do I have any rights to a refund and could I successfuly take legal action against a US comapany from the UK?
Any help and advice will be a great help.

Seeing as the products were insured could they not resend them a third time?
Also, I am assuming you paid by credit card. If you did then the credit card company have their own insurance to you and you can "claim back" the money through your credit card company.
In fact that's a note of advice for anyone, when shopping online use a credit card not a debit card.
