I have been offered a new job in writing and want to hand in my notice which is one month, because of pay issues i want to hand in my notice on 1st December (Paid two weeks in advance two in arrears) so that i get a full months pay as the new position does not start until 3rd January 2006.
i have 10 days holiday outstanding can i still take them without penalty or is it a case of i will be paid but have to work them.
I appreciate companies have different policy but what is the general rule.
(b) My contract says 1 months notice in writing i assume that bank holidays etc are included in that month.

This is normally the discretion of the company concerned. Just have a simple word with your boss and see what s/he says.
When I left my company to start up on myself, the boss was very helpful. I had just over a week myself holiday and I had the option to either take it as paid days, (to work) or take it as holiday and not get paid.
As I had to get the business up and running, I opted for the holiday.
