Hi,
I am looking to do a direct marketing project where I send out mail shots to potential customers. The mail shot will contain a flyer based mailer promoting my buisiness.
Now I know there are certain rules regarding telesales activities where you have to have your database checked with the TPS before cold calling but is that the same for direct mailshots? I mean is there anyting stopping me making a database from directories such as yellow pages and thompsons directory and sending out my mail shot to them without prior consent?

Hi,
I know of some companies who sell you names & addresses of opportunity seekers. Now, don't they in a sense sell you names & addresses to cold call ?
How come they never get in trouble ?
And what is TPS ?
What will you advertise ?
And to how many ?
Why don't you ask other members if they would like you to include their ads with your' on the mailshot ?
This way, you can charge them a little which is far lower than what it would cost them to mail-shot on their own.
Say, you shot 100,000.
Now your postage cost is 100,000*20p=£20,000.
You could include ads of 5 other companies in each mailshot and charge each of them 10p for each ad mailed.
It would have cost them 20p on postage for each ad they mailed on their own.
So, they save 50% on postage cost.
So, you would charge 1 company = £10,000 for 10,000 mail-shot.
5 company = £50,000.
Your profit : £50,000-£20,000 postage cost = £30,000.
If you decide to heed this tip and find other companies to partner your mailshot then don't forget to split the profits with me for giving you this tip.
Frankly, why don't you create another thread based on this idea looking for companies ?

It is law for all companies who sell mailing lists or telemarketing lists to work inside the TPS rules & regs. The TPS is the Telephone Preference Servce and business or the general public can register with them so they do not recieve unsolicited calls, 'cold calls'. Beware if you decide to make telesales calls with out having your database checked by the TPS, you could land yourself a ratehr big fine.
My query was about direct mail for my clothing business. The mail shot will introduce my business to retailers. I do not want to be associated with other business for this mail shot but thanks for the tip.
Anyone know if the TPS or similar organisation regulate mail shots or direct mail marketing?

There is the mail preference service (MPS) ran by the same people as TPS. Check out their corporate site to see what you may need to do to stay within the rules and regs. This is just to do with mailshots though.
If you are hand-delivering around a local area I am fairly sure the MPS doesn't apply but best to check first.

Directories such as Yellow Pages and Thompson are copyrighted and I have heard that there are bogus entries in there to catch people who use their lists. You can obtain a list of contacts from Yellow Pages but you have to pay.
Try your local business library to see if they can provide you with a list of targetted contacts (already cleaned). Some can provide a hundred or so free of charge to local residents (as this is usually a council run service) or more at a reasonable cost.
I believe that if people have approached you in the past, have bought from you in the past or have given you their details (e.g. business card, contact list at networking event) then it is legitimate to contact them.

Why doesn't MPS does not apply if you hand deliver ?
I mean, if you post then if people get pissed-off then they still do get pissed off if you hand deliver so I don't see what really changes if you hand deliver.
