....so any help or advice on this most basic of questions, would be much appreciated.
There are two of us, employed by someone miles away, (he has several 'gangs of two' in diff places) to work for him. I am giving serious thought to starting up on my own, and employing my workmate. He (my workmate)is in agreement, the contacts are there, work guaranteed, and I can finance the set-up costs from savings, and a little help from my Mum. (Bless her!) The big question is though, is it legal for me to quit work, then re-start straight away, and taking what are, in effect, HIS contacts? I have never signed a contract to work for my boss, if that makes any diff.

If you have never signed a contract, then that doesn't mean that you get away with what you want.
You need to get hold of the companies standard contract. If there's no provision in there for preventing you from starting a new similar company within a certain amount of months, then you are home and dryish. If there is, then you will probably have to abide by that even though you never signed it. But I would ask a solicitor or lawyer just to be sure. There's a lawyer locator on this page

In addition as the current work clients information is actually part of the property of the company you currently work for, however I'm sure that most of the information (phone numbers etc) are also in the public domain so they would be hard pressed to prove that you stole the information.

Many thanks Marcus, legal advise currently being sought, but looks good, have managed to get hold of a standard contract, and no mention of anything in this area. So far, so good.....
