Hi
I recently imported £3000 worth of goods from China. The goods arrived a few days ago. I paid the freight agent customs & dutys etc. They were supposed to be delivered on tuesday, so I called the freight agent to find out whats going on. The frieght manager told me that the couriers couldn't find my goods in the warehouse and they could of been stolen. If they have been stolen am I likely to get compensation ?, and who is liable for that ??. What can I do if my goods don't turn up ??, I am basically in big trouble if I don't get my goods or compensation as I have debts to pay and losing £3000 will ruin me.
Any advice would be great,

Thoughts are as above....did you take out insurance? If not it depends on the forwarders "rules". Is there a shipping agent involved or was this air freight direct to you. I guess this is a box/crate rather than a shipping container! I have had things go missing with RM only to re-appear a month later...hopefully they will turn up.

Firstly the companys/suppliers of the goods did not insure the goods and I am furious at that. I have bought from them before and they insured then.
A shipping agent did deal with my goods and I paid the customs and there fee's. I also paid them for delivery. As far as I know they gave my goods to a third party to deliver (the courier company). So if there is a delivery contract they (the agent) will have it.
The agent has said to me that I'm basically screwed because the people I bought the stuff off never insured my goods and all I can hope for is my goods to turn up.

Start preparing to fight to the last and if necessary to take legal action against the courier company. Since the goods entered the country, you paid customs duties, the liability is now with the transportation company. The point here is outright negligence, theft or deception. Since you never took delivery of the goods the fault is with the delivery company and start by getting a lawyer ......

The courier company should have "Goods in Transit" insurance which covers this. It is normal practice to have this in the industry. Do you know who the courier company is?

Sorry to have dragged this post from the dead. Since I made this post nearly 2 years ago I've gone through alot and still have big money problems. I have only just recently got myself a job and starting to get my life back on track but the debts are still hanging over my head and have accrued some interest.
I have a little spare money each month and was wondering if I've left it too long to try and claim some money back from the freight forwarding agents that lost/stole my goods. Its been nearly 2 years since it happened but I still have all the paperwork and evidence should I decide to go forward with a claim.
Does anyone think I stand a chance of getting anything ?. If so can you advise anybody I can speak to get the ball rolling ? or some literature to read.

The company is called Eagle Global Logistics and they are based near Birmingham airport. I was informed they are not a courier so there busness liabilty insurance doesn't cover jacksh*t and I'd be lucky to get a few hundred off them. Do you think my courier agent is just passing the buck to get out of paying me anything. The fact that they were lost after I payed customs etc should mean that I should get compensated to the amount that my goods are valued at. I will wait to see if I get anymore replies then I will think about getting a lawyer because I can't see how nobody is too blame for this as I should be fully compensated. I can't and will not just settle for a couple of hundred pounds and a crime number.

Have you spoken to the police?
Perhaps I am being Naive but if someone nicked £3k of my stuff I would have the cops down there instantly.
Perhaps it would be a good starting point to call police and lodge the fact that your goods have been stolen, then call the people who were storing them and tell them to expect police officers on the premises in the next few hours to interview staff, etc.
With a little luck the prospect of cops sniffing around and worrying other customers might make them reconsider their position and be a little more helpful.

speak to the police. my issue would lie with the payment of the goods. it is the responsibility of the seller to get the items to you. if they do not arrive then they have not fufilled this order. im not too sure if this stands in b2b transactions but it would be the angle i would chase.

Hi,
I import from Pakistan, and NEVER pay the frieght forwarder until 30 days after the goods have been delivered to me......Once the goods are in the country, and in the hand of the frieght forwarder, you pay the VAT/Import duty 'through' the freight forwarder, so he is basically saying 'I have your goods' - as he arranged to get the goods to you (by whatever means he can) then the liability is with him, as the last place you were aware of your goods being seen was with your freight forwarder - your beef is with him......he must then take this up with this 3rd party delivery company. If you import again, make sure that you are paying on a CIF (Carriage, Insurance and Freight) basis, this means that your supplier pays for the carriage to the ship, insures it to port of entry (i.e Felixstowe/Portsmouth etc)and pays for the actual freight (The cost of sending it on the ship) too.

Hi
I own a courier company and to be honest without goods in transit insurance they would find it very hard to trade.
So whether the goods stolen or lost they should be claiming from their insurance company.
