Hi,
Really quick explanation, I am currently starting a recruitment website called www.myjobs365.com - I am in the process of finding a company to rebuild the site as I am not happy with it but should be looking to launch early next year.
I have come accross another site called www.jobs365.co.uk - Should I be worried? I own both the .co.uk and .com for my name and have done for over 12 months. I also registered Myjobs 365 Ltd in April this year. I have checked Companies House and Jobs365 UK Ltd was formed at the end of June 2006.
Should I have any worries or is there any copyright infringement here? I do not want to spend a lot of money marketing only for the other site to piggy back on it (although, if the marketing is doing half the job it is supposed too they should not get confused anyway!)
Any advice?

A trademark would give you the highest level of protection, but this comes at a cost. It is worthwhile meeting with a trademark attorney - ideally a free consultation
- to ask them whether there may be grounds for a challenge on the name from the other party.
There may also be an issue because www.jobs365.co.uk are already trading (regardless of when the company name was registered).

Hi,
It was quite a surprise coming across this post!
I am MD of Jobs36 UK Ltd the "other" site that is being referred to here.
The company that owns us also owns all of the major jobs365 domain names. As you can see from a whois check, jobs365.com was originally registered on 08-Oct-2003 while some of the other domain names have been registered more recently. We have registered the domain jobs365.com for the maximum allowed period, it is currently due to expire in October 2015.
I note that myjobs365.com is dormant at present and I believe that it has never been functional. Our website is actively trading and we have quickly made a name for ourselves, you only have to search for jobs365.com on Google to see that there are over 400 entries returned.
I intend to seek legal advice on this matter in due couse, but in the meantime if you would like to contact me Ross, you can email on info@jobs365.com

I could not help replying to this exchange about use of the jobs365 brand even though it is rather historic. The problem of "names wars" is a growing area of commercial and legal conflict. The answer is always to check the availability of your name at the Trademarks Registry first. If it is not already registered...register it right away. It costs £200 in one class if you do it yourself..... but it is an absolutely crucial to do it otherwise you will probably need to re-brand at some point if someone else does come along and register the name.
