I think that as long as you do not use your work time to work on your personal work and it is does not compete with your company then the company you work for should not have any issues. If it is something you do outside of work then they do not need to know.
I would suggest that you both set up a limited company as this would offer you both some protection and from this set up a business bank account and keep if for business banking only. HSBC are quite good just call into your local branch and they can explain the benefits.
Both you and your partner should be listed as directors it is better to set it up as you mean to continue and this way you will not have any problems done the line. i.e if you and your close friends stop talking they are still a director in the company that you and your partner have worked hard to set up.
It is also advisable to talk to an accountant before you start and they will be able to offer you sound financial advise as your tax may change if you are earning on the two jobs.

Your contract of employment contains a fairly wide reaching clause restricting your activities in the same field and your additional business activities could be considered to be a breach of your employment contract.
You and your partner should take legal advice on this before proceeding further with your additional business venture if your main income is to be retained as a priority. In spite of the comment by the other poster there is a contractual agreement with your employer that you have signed which affects your ability to carry out a business in the same field.
Your option, subject to the whole contract conditions is to look at other business ventures not in the same field as your employer.

Thanks for the replies...
The additional work that is available to myself and partner is in no way the the same field at all.
For example, my partner works full time at a finance company but has the option to work in the IT field on weekends/evenings. And I have the opportunity to work in the 3D animation field on weekends where as I work in the IT field during the week.
My plan at the moment is for my partner to be the director of the ltd company and a family member (that has a different surname) to be the secretary.
Can you see any issues with this?
Where would be the best place to get legal advice?

It's worth having the whole contracts looked over as often these sort of clauses have earlier links in the contract to consider. If it is just as drafted above then that turns it completely in your favour of course

Hi Bedrock,
Be careful with the Ltd company idea if you do not intend to do other work for anybody else. There is something known as IR35 that may apply. If you need any help do not hesitate to ask.
