Thank you for both of you. I have made a Trade Mark checking and the result was "refused", the explainaton of this word is interperating by the Pattern Office as someone has made the application to register that name for Trade Mark but has been refused. So does it means that this name has not been register yet? Since the checking result showed no record of registrar.

yes it means their application has been refused. Given that you now want to use the name it is worth looking at reasons why the name has been refused trademark status by asking the Patent office for some more details.
